TERMS AND CONDITIONS FOR TURBO DA

PLEASE READ THE FOLLOWING TERMS AND CONDITIONS CAREFULLY BEFORE USING TURBO DA.

BY CLICKING TO SIGNIFY ACCEPTANCE OR OTHERWISE ENGAGING WITH TURBO DA, YOU AGREE TO BE BOUND BY THESE TERMS.

About these Terms. These terms and conditions for Turbo DA (“Terms”) constitute a legally binding agreement between you (“you” or derivatives thereof) and Avail Technology Limited, a Dubai International Financial Centre company with registered number 7545 (“us” or derivatives thereof) and governs your use of Turbo DA. These Terms supersede and merges all prior oral and written agreements, discussions, and understandings between you and us with respect to its subject matter, and neither of the parties will be bound by any conditions, inducements, or representations other than as expressly provided for herein.

About Turbo DA. “Turbo DA” is a service that posts data on your behalf to the Avail chain. You can buy “credits” which allow you to post data via the service at a guaranteed rate.

Electronic Signature and Disclosure Notice. You agree to the use of electronic documents and records in connection with the use of Turbo DA—including without limitation this electronic signature and disclosure notice—and that this use satisfies any requirement to provide you these documents and their content in writing. If you do not agree, do not accept these Terms.

Changes to these Terms. We reserve the right to change these Terms from time to time in our sole discretion. If we make material changes to these Terms, we will provide notice of such changes, such as by posting the revised version of these Terms through the Turbo DA Dashboard. By continuing to access or use Turbo DA after the posted effective date of modifications to these Terms, you agree to be bound by the revised version of these Terms. If you do not agree to the modified Terms, you must cease using Turbo DA and we reserve the right to terminate your participation.

  1. Definitions. Capitalised terms not otherwise defined in the body of these Terms have the following meanings:
    1. “API Key” means the unique identifier or identifiers that you will be provided with to use Turbo DA.
    2. “AVAIL” means the AVAIL cryptographic token.
    3. “Avail Project” means the collective set of activities, technologies, and operations linked to the Avail chain. Further details of which can be found at https://www.availproject.org/. ****
    4. “Avail Turing” means the Avail turing testnet.
    5. “Network Companies” means all companies part of the Avail Project from time to time.
    6. “Privacy Policy” means our privacy policy accessed [at https://www.availproject.org/][on the Turbo DA Dashboard].
    7. “Turbo DA Dashboard” means the interface used to access and engage with Turbo DA.
    8. “Turbo DA Email” means [[email protected]].
  2. Term. These Terms commence upon the earlier date of you signifying acceptance or otherwise engaging with Turbo DA and, unless terminated earlier in accordance with these Terms, shall continue until your account is deleted or terminated.
  3. Turbo DA Requirements.

3.1 Registration

  1. You, as a customer of Turbo DA, can be any legal entity or individual who fits within the requirements of Term 4 below provided you have successfully completed the registration process.
  2. During registration, you must provide us with such information as we request at that time, this may include, but is not limited to, your e-mail address, country of citizenship, country of residence, and age. We reserve the right to change the scope of the requested information or to request additional information or documents from you from time to time. In particular, we may be required by applicable law to periodically update customer identification information and conduct respective checks.
  3. We may also, but shall not be obliged to, provide access to Turbo DA through third-party login providers (such as Google or Hotmail). We are not responsible for any interruption in the use of Turbo DA due to your access through such providers.
  4. After you provide us with any requested data and we conclude that you have successfully passed the registration, we will grant you access to Turbo DA and provide you with the ability to generate API Key(s) for your account.
  5. We reserve the right to refuse your registration for any reason at our sole discretion.
  6. You warrant that all provided information is true, accurate, complete, and not misleading. You agree to maintain and update such information in your account on time to remain true, accurate, complete, and not misleading and agree to inform us of any changes.
  7. In case you do not provide us with the information in accordance with our request or, in our opinion, the information provided to us is not sufficient or satisfactory, in our sole discretion, we may immediately restrict, suspend, or terminate your right to use and access Turbo DA without any prior notice to you.

3.2 Use of Avail DA
